How to conduct yourself during a DUI arrest

Getting pulled over by a police officer on suspicion of driving under the influence (DUI) can be a stressful and overwhelming experience. However, remaining calm and following simple steps is vital to protect your legal rights and ensure the best possible outcome.

See below to learn about the best conduct during a DUI arrest. There are no guaranteed outcomes, but taking every precaution will improve your chances.

Pull over promptly and safely

First, pull over to a safe spot as soon as it is safe. Turn off your vehicle and place your hands on the steering wheel. Avoid making sudden movements or reaching for anything until instructed to do so.

Comply without incriminating yourself

Be respectful and cooperative with the officer. If they ask for your license, registration, and proof of insurance, provide them promptly. Avoid admitting guilt or providing self-incriminating statements.

Field sobriety tests are not legally required

You can decline if the officer asks you to perform field sobriety tests. These tests are voluntary and often unreliable. However, you face suspension of your driver’s license if you refuse to take a breath test. Pennsylvania legislation mandates that anyone who drives a motor vehicle implicitly agrees to take a blood or breath test.

It is important to remember that a DUI charge does not necessarily mean a conviction. If arrested, remain silent and request to speak with an attorney. Do not answer questions or provide statements without legal counsel.

Getting pulled over on suspicion of a DUI can be a frightening experience. However, by remaining calm, respectful and cooperative with the police, you can protect your legal rights and ensure the best possible outcome.
