What are my next steps after a DUI arrest?

Time is absolutely crucial in the aftermath of a DUI arrest. Your arraignment will take place 48 to 72 hours after your arrest, and your preliminary hearing occurs within 30 to 60 days from the date of your arrest. During these initial hearings, your choice in representation can mean the difference between dropping or lessening your charges and facing possible jail time.

The following are several steps you should take after a DUI arrest:

  • Using your Fifth Amendment right to remain silent – According to your Miranda rights, any statements you make can be used against you in court. While police officers may make it seem like they want to hear your side of the story, it is best to avoid providing any further details and wait until you speak with your attorney before answering questions.

  • Contact a DUI defense lawyer – To ensure you obtain the best possible outcome in your case, you may need to hire a criminal defense attorney who has ample experience handling DUI cases, especially those similar to your situation.
