Penalties for DUI with Injury

Prosecutors can apply this charge in addition to a standard DUI charge, even if the injury another person suffered was minor. However, it’s up to the prosecution to prove you are guilty of causing this harm. In order to be charged with a DUI with injury, the prosecutor must show you broke the law or were negligent when driving and that your actions caused another person’s injury.

If your DUI caused severe injuries, you could be charged with aggravated DUI assault, which is a 2nd-degree felony. You could also be fined a maximum of $20,000 and face up to 10 years in prison. If the DUI led to the wrongful death of an individual, you would be confronted with a charge of vehicular homicide, which is a 2nd-degree felony. This charge will lead to a mandatory 3-year prison sentence, in addition to which, you may also have to pay a $25,000 penalty.
